| 作为一种违约补救措施，实际履行制度在国内立法和国际法律文件中得到体现。
CISG、UPICC和PECL这3个国际法律文本是国际贸易统一实体法的重要成果，对国际
贸易产生了重大影响，三者都对实际履行制度作出相应规定，但是三者的相关规定存
在一定差异。通过详细比较分析三者的实际履行制度，该制度包含已经统一的内容和
尚未统一的内容，该制度应进一步统一。通过借鉴CISG、UPICC和PECL中的相关规
定，我国《合同法》中实际履行制度应进一步完善。 |

| As a remedy for breach of contract, specific performance system is embodied in domestic legislation and
international legal instruments. CISG, UPICC and PECL, and other international legal instruments, as important
outcome of the uniform substantive law in international trade, have had a significant impact on international trade,
and have made the corresponding provisions on specific performance system. But there are some differences in the
relevant provisions. Based on a comparative study of the specific performance system in CISG, UPICC and PECL,
it is clear that what has been unified about the specific performance system and what is not unified. Suggestions are
put forward to promote the further unification of the system. According to the relevant provisions of CISG, UPICC
and PECL, improvement of specific performance system in China’s contract law is needed |
