| 保障措施作为一种贸易救济措施，被称为自由贸易的“安全阀”。自由贸易协定中关于保障措施的规定经历了从无到有和从不完善到相对完善的过程。在保障措施制度的设计方面，自由贸易协定多数援用 WTO规定，但自由贸易协定也有其特别的保障措施规定。这就需要比较 WTO保障措施制度与自由贸易协定保障措施制度的具体规则，总结自由贸易协定保障措施制度本身的特征和立法内涵，进而结合中国实践推进自由贸易协定中保障措施条款和立法的完善。 |

| Abstract: |
| Safeguard measure, as one of the trade remedy measures, is known as the“safety valve”of free trade. Most free trade agreements and regional trade agreements have stipulated the provisions of safeguard. Many FTAs directly invoked the provisions of safeguard measure from WTO legislation, but FTAs also have their special rules on safeguard measure. It’s necessary to compare the safeguard measure under WTO and FTA, so as to summarize the characteristics and contents on safeguard in the legislation of FTA, and give further impetus to the developments of safeguard measure and legislation in China FTA. |
