| 团体标准在其制定和实施中存在逆向选择现象。通常标准制定中的要素选择瑕疵是导致团体标准产生逆向选择效应的主要原因。欧盟通过适用 FRAND原则对“标准必要专利”的许可、适用加以规范和约束。我国应借鉴欧盟经验,解决标准必要专利的实施许可问题,提高专利价值认定的可接受性,同时科学选择团体标准的技术指标体系,以团体标准的开放性、其市场主体和专利 (池 )的多元化来解决团体标准发展的堵点和痛点。 |

| Abstract: |
| Group standards have adverse selection in their formulation and implementation. In general, the defect of element selection in standard setting is the main cause of adverse selection effect of social organization standard. By applying the principle of fairness, reasonableness and non-discrimination (FRAND), the EU regulates and restricts the licensing and application of“standard necessary patents”. China should learn from the experience of the European Union to solve the problem of the implementation of standard essential patents, improve the acceptability of patent value recognition, and scientifically select the technical index system of social organization standards, and solve the blocking points and pain points of the development of social organization standards by strengthening the openness of establishment of social organization standards, the diversification of their market subjects and patents or patent pools. |
