| 俄罗斯是“一带一路”沿线的重要国家。中国对俄投资量大，双方经济互补，且在投资领域具有很大的合作潜力。“一带一路”倡议为促进中国对俄投资合作提供了良好的契机。中国中央和地方政府出台的一系列与“一带一路”倡议相关的政策、中国对外投资的国内立法、中俄双边条约和俄罗斯外商投资的相关法律法规都可以为中国对外投资者在俄罗斯的投资活动提供指引和支持。但由于两国政治经济的差异，中国对俄投资仍然面临俄罗斯法律环境不稳定、税收复杂繁冗、投资模式以及环境保护等法律风险，较高的投资壁垒易使中国投资者遭受严重损失。因此，中国对俄投资需要提高法律风险防范意识，利用法律保护自己的合法投资权益，规避或者降低法律风险，在“一带一路”倡议的指引下顺利开展对俄投资合作，提升经济实力，促进互利共赢。 |

| The Legal Risks and Solutions of China’s Investment to Russia Under the Belt and Road Initiative |

| Russia is a country of vital importance along the route of“One Belt One Road”initiative. China’s investment amount to Russia is large. There is mutual complements and great potential for cooperation in the field of investment between the two countries. One Belt One Road initiative provides a great opportunity for China’s investors to promote the investment in Russia. A series of policies related to the One Belt One Road initiative carried out by China’s central and local governments, the domestic legislation of foreign investment in China, bilateral treaties between China and Russia as well as Russian laws and regulations concerning foreign investment can offer guidance and support to Chinese investors in Russia. However, due to the political and economic differences between the two countries, Chinese investors in Russia are still facing many kinds of legal risks, including risks of Russia’s unstable legal environment, complicated tax system, lack of domestic legislation, investment model and environmental protection. Therefore, Chinese investors in Russia need to raise the awareness of preventing legal risks. Only by using the law to protect their legitimate rights and interests can Chinese investors carry on the investment cooperation with Russia successfully, enhance economic strength as well as achieve mutually beneficial and win-win results under the guidance of One Belt One Road initiative. |
