| 《巴黎协定》开启了“五年评审 +国家自主贡献”的全新模式，各国针对减排的资金安排也出现了变化。气候融资视角下的碳金融是将二氧化碳排放权与资金融通相结合的新型融资方式，它不仅具有以碳配额作为新型标的资产融资的特殊性，而且在交易上也具有复杂性。为保障后巴黎时代以气候融资为主的碳金融业务顺利开展，需要建立、完善和创新国际碳金融法律制度。中国已于 2017年 12月统一了全国碳交易市场，并在国际气候融资领域有较多的融资渠道，但在碳金融的机构设置、碳金融产品和碳金融服务等方面还缺少法律规制。因此，在借鉴国际碳金融监管法律制度的基础上，建立中国气候融资视角下碳金融法律制度，对保障中国统一的碳市场健康发展具有重要意义。 |

| After the Paris Agreement, the new model of“five years of review plus national independent contribution”has been launched, and the financing arrangements for reducing emissions have also changed. Climate finance perspective of carbon finance combines CO2 emissions with financing in the new financing way, It not only has the particularity of financing with carbon quota as the new target asset, but also has the complications in trading. In order to ensure the smooth development of the carbon finance business dominated by climate finance in the post-Paris era, the international carbon finance legal system needs to be formulated, improved and innovated. China unified national carbon trading market in December 2017 and has more financing channels in the field of international climate finance. However, the framework also lacks legal regulation in the carbon financial institutions, financial products, carbon financial services, etc. Therefore, in reference to the international carbon, on the basis of legal system of financial regulation, formulating climate finance perspective of carbon financial legal system in China, it is of great significance to guarantee the healthy development of carbon market. |
